A Texas hospital has reportedly instituted a hiring policy barring potential employees who are obese -- and officials at the Equal Employment Opportunity Commission tell FoxNews.com that the practice is not explicitly discriminatory.
It must be nice for a company to set a hiring policy.
With all due respect Mr. Kevin, I'd rather be worked on by a fat person who knew what they were doing than a skinny one who didn't. The bean counters strike again IMHO. How long until everything you decide to do in your life is someone else's business? Freedom means the freedom to mess up, just as much as it means the freedom to succeed, and I've never met a man or woman who did everything right.
As a fat guy, I would be barred from employment there. That said, it's none of .gov's business who a company hires.
If the skinny folks are generally incompetent, the hospital will get fewer patients and their bottom line will suffer. They will then relax the rules, make exceptions, or abandon the idea. If the skinny people are competent, then it's win-win for everyone except the fat guys like me. We'll have to lose weight or find somewhere else to work.
Come on man. Fat people gotta eat too. Maybe more than others but if they can do the job what difference does it make how freakin big they are. This crap cant stand for long.
Justine Lisser, a senior attorney and adviser at the Equal Employment Opportunity Commission, said the Americans with Disabilities Act would prohibit discrimination against the morbidly obese since that can be a covered impairment.
"There are, however, people who may have a BMI that is higher than what the hospital required, but not so high as to constitute morbid obesity," Lisser wrote in an email to FoxNews.com. "Unfortunately, these people would not be covered by our laws prohibiting discrimination because they would not have a covered disability."

What I find funny is that hospitals will not hire drinkers or definitely not smokers, but they will hire morbidly obese people. Isnt that just as unhealthy, or more unhealthy?
I have a customer who was overweight before, even though his 4 brothers and 1 sister are either standard weight for their size, or slightly overweight. But now that customer has retired, is now completely stagnant in his lifestyle, eats and drinks very unhealhty stuff, gets no exercise, etc. So in just 3 years or so, he went from being about 5'11", 240lbs to about 400lbs!
It has nothing to do with genetics either.
But whats interesting and hypocritical, is that his 1 daughter is shorter(5'9") and weighs more than him! She is about 420lbs or so... Even though her sister is not overweight at all! But this lady works as a nurse in the largest hospital in the state. Even though they wont fire her, they have discretely moved her to night shift.
Whats worse, is that her and her morbidly obese husband, who live with my customer even though they are both in their mid-late 40's, are total pigs in the way they live and eat. Her old apartment was unbelievable! I took a job in the 90's demolishing properties in the city, and we did a couple vacant crack houses, and her apartment was worse than those crack houses! It was complete squalor. She is now turning her father's home into how her apartment was, and couldnt care less....She is an animal and trash hoarder.
Plus, she leaves her clothes all over her bathroom floor, right under their filthy toilet! There is urine on the floor too. This includes work uniforms used by her at her nursing job, but nobody there seems to care!
But God forbid she was a smoker! She'd be fired in a heartbeat then!

It's been my experience that people with house pets have the most filthy homes regardless of their size/sex/race.
But does that mean that all pet owners are slobs??
Seriously, who wants pet hair all over them, dander, dust, pet urine, feces and other smells the owner totally does not notice, but that hits you like a wave when you open the door to go in. Nasty indeed, and these are thin people who are active and healthy! LOL (In many cases, otherwise they'd be hording fat slobs that just happen to have housepets...)
If being physically fit was a sign of intelligence, aptitude and performance, we should be well served by Obama eh? But in reality, he's a massive failure, our economy remains constrained, government even more bloated and expensive and that other "thin dude" Harry Reid and his thin counter part Nancy Pelosi sure did great things for our nation...
I'd take a fat dude like Christy anyday over all three of them. (And he quite likely might have the same personal mass... LOL)
Companies like this hosptial that consider outward appearance over performance or ability are missing some great people and opportunities in my view.
Reality is an expanding group of Americans is obese. (Excuse the pun..) Does that mean we have as President Obama claims, become a lazy nation that is no longer competitive?
I agree with Dirty Harry that they should be able to hire whoever they want based upon their perception of the candidate. Plus they shouldn't even have to give a reason for why they didn't hire an applicant, no matter the reason.
The real question is can they fire you for becoming obese or overweight after they hire you? I don't know if by law (depending upon the state) any organization can dismiss someone because of their own personal preference (like smoking) that doesn't effect your performance. Some states are "at will employment" so employers can fire employees for basically no reason and not break contract.
Like in the movie Ocean's 13 maybe if hospitals hire all of their staff as "models that cure" they can hire and fire them based on their weight and physical appearance. This whole thing is a lawsuit waiting to happen. Although I do think they should be able to hire whomever they want, I don't think they should be able to fire an employee for a personal preference or their physical appearance. What an employee does off the clock is their business, whether it be binge drinking or eating. As long as they show up for work on time, abide the law (aren't drug addicts), and perform well then what they do off the clock is nobody's business. Hospitals are not in the entertainment industry so employees appearances shouldn't matter....

You are WAY off base there bro.... I didnt say any such thing as "all fat people are slobs" You put those words in my mouth.... I know many overweight people who ARENT slobs. Most arent.
I was talking about 2 people in particular, and I made that pretty clear. I was only talking about my client's daughter and her husband, who are animal hoarders and major slobs! They have 8 cats for God's sake and would have even more if it wasnt for my client putting a 'governor' on their behavior. I was there again today, and they have absolutely trashed his brand new, completely insulated and finished shed he paid $4200 for! They are using it for 4 cats, and they dont hardy ever change the litter box, so the cats are peeing all over the new carpet... I think you can agree thats a pig! That person would be piggy regardless of whether she was obese, or anorexic.
They have also broke the handle off a new steel cabinet, and put a major dent into an even newer one just bought 3 weeks ago!
It's always something with these 2. But, as far as the point of the thread, I think that if you can be fired for smoking because it's unhealthy, then if you are 250 lbs overweight and filthy, then you should also be fired from a health care center. If you are as skinny as a heroin addict and filthy, you should also be fired from a health care center.
How are those 2 examples 'better' than someone who walks outside to smoke a ciggy every hour or so?
