my political ilk, if thats what you are asking, does not side with gun control and never sides with a particular political party. unfortunately, gun control is one of many political issues that must be weighed when selecting a political candidate. i have plenty of contradictory political views when analyzed from the perspective of a two party system and there are those who confuse scientific views with political affiliation as well.

in my opinion, gun control as a govt function is pretty much dealt with by the 2nd amendment. aside from some minor regulation in a few areas, (i.e. maybe some state or fed laws regarding possession by convicted violent felons, concealed firearms by minors or in schools, licensing or registration for full auto M60s, howitzers, and other weapons of potential mass destruction) gun control should pretty much be eliminated and certainly not a cause for much political controversy.

one thing for sure is that i really love my guns and always want to buy more guns and damn sure ain't gonna give 'em up to no one, no how. I am a firm believer in 2nd amendment rights and can argue that stuff til the cows come home. doing that here would be preaching to the choir though.

it is a shame that there is not more effort to separate the issue of gun rights from political party affiliation. i know plenty of democrats who own and enjoy firearms. it is a shame that many of them vote for politicians who may not support gun rights just b/c other issues compel them to do so. i wish more democratic politicians would grow the balls to stand up for gun rights or that more politicians in general would grow the balls to become independents.

First off lets get one thing straight. Calling Representative McCarthy names and saying that she needs to be slapped is not appropriate. Grow up. You are making yourself sound like a jerk. I disagree with her politics too, but there is no need for Internet Tough Talking. You destroy your own credibility by saying things like that.

Now, with that out of the way, lets look at the article you referenced and talk about the bill that Rep. McCarthy is planning on introducing.

"...McCarthy is expected to drop the Fix Gun Checks Act of 2011 — a near-identical companion to that of fellow New Yorker Chuck Schumer’s Senate bill — according to sources familiar with the legislation.

A draft of the bill obtained by TheDC makes clear that McCarthy’s legislation significantly mirrors Schumer’s much-publicized bill and would make three significant changes to current national gun laws. McCarthy’s proposed fixes include gun-control advocates’ long-sighted target in the national firearms debate — closing major “loopholes” of the milestone Brady Handgun Violence Prevention Act.

Like its Senate companion, the House bill would also increase penalties for states that do not comply with the NICBC’s current requirements. States that do not make available the data needed to assess those who are or may be prohibited from possessing firearms could face reductions in the amount of federal crime-fighting funds they receive.

Another major provision of both bills focuses on the mental health issues of those seeking to possess firearms.

Apart from further defining and stipulating who qualifies as a “mental defective” both bills call for the development of mental health assessment plans for institutes for higher learning. Both bills would require federally funded colleges to develop a plan for the institutes to address risks posed by students who appear to need mental health help. Colleges must have a mental health “team” ready to assess potentially dangerous students as well as procedures in place for making voluntary and involuntary mental health referrals.

- The first part of this that touches on the provisions of the bill are that it increases penalties for not complying with current NICBC requirements.

States that do not make available the data needed to assess those who are or may be prohibited from possessing firearms could face reductions in the amount of federal crime-fighting funds they receive.
So if your state doesn't meet Current Requirements then they will have to do so or lose federal funding. This does not seem to be such a big deal to me. The next logical question is whether or not your state is even effected by this. This doesnt seem to be something to get too riled up about.

- The next part that I see in this article is the part about clairifying what mental issues that doctors and colleges should be reporting to the NICBC system.

As I understand it this was part of the reason that the Nut from Virginia Tech was able to leagally buy a gun. If the state of Virginia and Virginia Tech had had a clearer understanding of what they should have been reporting, they would have reported Mr Short-Korean-I-Hate-the-world-andcantgetadate and he would have not been able to stroll into the local gun store and buy his guns.

It should be noted that he could have gotten guns from other sources, so this may not have prevented the tragedy, but it might have alerted the police to pay him a visit...so maybe it would have.

There are definite Civil Liberties issues here. Potentially this could mean that if you suffer one bout of depression your doctor could rat you out to the feds and summarily remove your 2nd Amendment rights. That is the risk, but lets get the details and see if that is what the bill actually says before flipping out like Donald Duck having a conniption fit.

Oh, and its worth point out that this Bill is probably going to die in committee.

Sounds like Ms McCarthy's Shocking New Gun Control Bill is basically saying what the NRA is usually saying. "Enforce Current Laws" with a little clarification thrown in to the mix.

I fail to see the reason for outrage. Get a grip.

Now, if there is something that I am missing, please feel free to educate me. Perhaps there is a provision in there that says "Carolyn McCarthy and the ATFE-FBI-CIA-DEA-DHS-ICE-and IRS are coming to confiscate everyone's guns" then I want to hear all about that.

This part was down at the bottom of page 1 of the article.

Two days after Obama’s op-ed, Schumer — along with McCarthy, Bloomberg and several other leading Democrats — held a press conference in front of the Capitol to push for more gun-control legislation. At the time, McCarthy indicated she was days away from introducing her companion piece. As the weeks went by, McCarthy’s office said it was carefully reviewing the legislation and listening to various concerns.

McCarthy appears to have taken some of those concerns to heart. Conspicuously absent from the Representative’s legislation is Schumer’s controversial proposal to ban the possession of firearms to anyone who’s been arrested, but not convicted, of a drug-related crime in the past five years.

...Specific legislation to close the “gun show loophole” has been introduced in nearly every Congress since the Brady Act was passed and McCarthy has been a key figure in the annual fight. The representative has sponsored legislation specifically targeting gun shows at least six times in the past 11 years, including the most recent Gun Show Loophole Closing Act of 2011. McCarthy’s draft bill is exactly like Schumer’s most recent senate bill, however, in that it offers general prohibitions against any “unlicensed transferor.” Gun shows are not specifically mentioned in either the bill but it essentially means anyone who is not a licensed firearms dealer or any agent of the state capable of conducting immediate background checks.

Another key concerns of gun-control advocates, the availability of high-capacity magazine clips, is not mentioned in either bill.

Here we have Rep McCarthy wanting background checks on private sales. Predictable and BigBrother-ish but nothing new and of course this is DOA in the Congress. This is foolishness gets brought up every year and every year it dies in committee. In one sense its not such a bad idea but it reality its a Loser because there is no enforcement mechanism to make sure that this happens And this has failed in Congress for years for that very reason...among others. Namely, if there was an enforcement mechanism it would be a National Gun Registry...which is a wholly abhorrent idea. As evidenced by Canada's current debate about killing their long gun registry.

Notably, the ban on std and extended capacity magazines seems to have gone away in this bill. That's refreshing.

Well, this has certainly gone long.

Cheers,

-S
