According to the BATFE's FAQ, it seems I can only ship to someone out of state if they hold an FFL. As for these cryo-treatment places that advertise for firearms, do they hold FFLs, or is the BATFE's FAQ wrong, or am I missing something?

A nonlicensee may ship a firearm by a common or contract carrier to a resident of his or her own State or to a licensee in any State.http://www.atf.gov/firearms/faq/faq2.htm#b8

After a search, it seems as if most cryogenic treatment posts on this board are about the Mini-14, so that's why I chose this forum to post this question.

I can't quote the regulation title number but you have to transfer it through an FFL holder ONLY if you are selling it or transferring ownership for some reason. If you plan on owning it after it is returned, an FFL holder is not required. I see question B9. The words lawful activity includes repairs and modifications. The modifications cannot be modifying it to a machine gun or putting on a silencer.
Also check question I3. I think the BATF keeps the rules vague so they can spin them to their advantage if need be. I'm sure some of the cryo treating places have done this before and know what the issues are.

The US postal service can ship a rifle without an FFL but you may have to educate them about your right to do so. I've learned that many clerks are kept in the dark and fed bull$#&& about the rules. kwg

When shipping a firearm as a non-licensee you may ship directly to a licensee. After repairs or modifications a licensee may ship directly to the owner of the firearm from whom they received it.

The Postal Service does allow for a non-licensee to ship to a licensee, but the return trip is not so easy. When shipping firearms by mail you must declare so and fill out form 1508, "statement of shipper of firearms". This forms states that you are shipping to an FFL holder. That's why folks can ship send firearms to me through the mail, but I can not return it through the mail unless they have an FFL.

You will also find many headaches with the uninformed of UPS and FedEx. FedEx in Salem, Oregon refuses to ship firearms for me, but delivers those coming to me. It doesn't matter that I have all the proper documents, the oh so helpful shipping boss will not accept fireams, so I use UPS exclusively.

Contact the person or business who will receive the firearm and ask about their shipping requirements.

Always require an adult signature with firearms shipments, insure the package and declare that it is a firearm. You will only be paid for MSRP replacement value of the firearm regardless of over insurance, and if you claim it as anything but a firearm your claim should damage or loss occurr could be a fancy table lamp.
