OK, folks: The 9th US Circuit Court of Appeals ruled that the 2nd Amendment does NOT guarantee an individual’s right to own guns. This morning the Supreme Court has refused to hear a challenge to that ruling by the NRA.
The original lawsuit involved the individual’s right to own banned assault weapons. By refusing to hear it, the Supreme Cout allows the lower court's ruling to stand.
We need more information on the specifics of this ruling!
This may not have been the case that the US Supreme Court wanted to hear.
Any 2nd amendment case that has anyone claiming that it, grants, affords, guarantees, gives, or any other words to that effect, is almost certainly doomed. This is the trap I referred to in another post. The case that needs to be brought before the Supreme Court should assert that our natural or "god-given" right to bear arms is being infringed in violation of the 2nd and 14th amendment. The history of the debates that went into the adoption of the 14th amendment shows that its intent was designed to prohibit newly freed slaves from having their right to bear arms infringed by the former confederate states. These debates acknowledge the right to bear arms as an individual right. Today, historically challenged history teachers ignore this important fact and merely state that the 14th amendment was adopted to prohibit the states from passing so-called Jim-Crow laws. The only positive thing I have heard as a result of this is that the SC is waiting until they have enough " individual right" votes to settle the matter. I like to think that its true but is that wishful thinking? :(
